Louisiana prosecutor: Man’s death by cops a ‘state-authorized killing’

The two white officers at the center of the racially-charged killing of a black man in Baton Rouge, La., may have acted within the law when at least one of the cops fatally shot the father of five after he was restrained, a city prosecutor said Thursday.
“This is potentially a state authorized killing,” East Baton Rouge District Attorney Hillar Moore told CBS News. “It gives law enforcement officers the authority and mandates them to kill when in defense of themselves or others.”
Baton Rouge police have insisted that Alton Sterling, 37 – who has a lengthy rap sheet — was armed when the officers approached him during the confrontation early Tuesday. But two cell-phone videos of the shooting fail to show Sterling with any weapon.
Moore’s statements conflict with the reaction of outraged community members, who took to the streets Wednesday night in angry protest over the deadly shooting by veteran officers Blane Salamoni and Howie Lake.
The two cops have been placed on administrative leave, as per the department’s policy in officer-involved shootings.
Aboard Air Force One on Thursday, White House spokesman Josh Earnest told reporters that President Obama was “deeply disturbed” by the Baton Rouge police shooting and “is following the situation closely.”

The FBI and the US Justice Department’s Civil Rights Division have launched a civil rights probe into Sterling’s death. The Baton Rouge Police Department is spearheading the criminal investigation.
Also on Thursday, the Daily Beast posted an updated version of the cell phone video the news site had previously obtained, offering a broader picture of what happened.
It begins with the two officers kneeling over Sterling, who is putting up a fight while pinned to the ground.
One of the cops pulls his gun from his holster and aims it at Sterling’s chest, screaming, “I swear to God if you f—ing move!” followed by “He’s got a gun.”
The camera then jerks away as several shots are fired, but quickly pans back to Sterling lying spread-eagle with blood pooling in the chest area of his T-shirt.

“F–k! 10-4, 10-4… shots fired! Shots fired!,” one of the cops yells into his radio. He then removes an object from the pocket of Sterling, whose arm limply swings across his body as the video ends.
Meanwhile, CNN reported Thursday that a homeless man had placed the 911 call that brought the officers to the scene early Tuesday morning after Sterling had pulled a gun on him for begging for money.
“When officers arrived, Sterling was armed and the altercation ensued that resulted in the loss of his life,” Baton Rouge Police Chief Carl Dabadie Jr. has said, adding that “no stone would be left unturned” in the probe.
Investigators have the officers’ body cameras, but they were jostled during the struggle with Sterling, diminishing the quality of the footage.
